TERMS OF SERVICE

Please read these Terms of Service ("Terms") carefully before using the website themakenziehouse.com or inquiring about or booking services with The Makenzie House ("TMH," "we," "our," or "us"). By accessing our website, submitting an inquiry, or booking our services, you agree to be bound by these Terms.

1. ACCEPTANCE OF TERMS
By using our website or services, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are booking on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

2.  SERVICES OFFERED
The Makenzie House is a luxury boutique glasshouse on two acres offering services including, but not limited to:
  • Wedding ceremonies and receptions
  •  Elopement packages and courthouse ceremony experiences
  •  Micro-weddings and intimate celebrations
  •  Proposals and anniversary events
  •  Vendor markets, community events, and private gatherings
  •  Photography sessions and themed shoots
All services are subject to availability, venue policies, and the terms of your individual booking agreement or contract.

3. BOOKINGS & CONTRACTS
All event bookings require a signed contract and a non-refundable retainer to secure your event date. Your event date is not confirmed until both the signed contract and retainer payment have been received by TMH.

Specific terms governing your event — including payment schedules, cancellation policies, guest counts, vendor rules, and add-on services — are outlined in your individual booking contract. In the event of any conflict between these Terms and your signed booking contract, the booking contract governs.

Your event date is not held or guaranteed by an inquiry alone. Dates are confirmed only upon receipt of a signed contract and retainer payment.

4. PAYMENTS & PRICING
All pricing is subject to change without notice until a booking contract is executed. Quoted prices are valid for the period specified in your proposal or quote. TMH reserves the right to adjust pricing for services not yet contracted.
Accepted payment methods are detailed in your booking contract. Late payments may result in cancellation of your event booking per the terms of your contract.

5. CANCELLATIONS & REFUNDS
Cancellation terms are governed by your individual booking contract. Generally:
 • Retainer payments are non-refundable under all circumstances.
 • Cancellations made within a specified window prior to the event date may result in forfeiture of additional payments made.
 • TMH reserves the right to cancel a booking in cases of breach of contract, venue damage, or circumstances beyond our control (force majeure), with appropriate notice provided to the client.

In the event TMH must cancel due to circumstances within our control, we will make reasonable efforts to reschedule your event or provide a partial refund as outlined in your contract.

6. VENUE RULES & CLIENT RESPONSIBILITIES
By booking TMH, you and your guests agree to abide by all venue policies communicated at the time of booking and any posted on-site. You, as the booking client, are responsible for:
 • The conduct of your guests and any vendors you bring to the venue
 • Any damage to the venue, furniture, equipment, or property caused by you, your guests, or your vendors
 • Compliance with all applicable local ordinances, noise ordinances, alcohol regulations, and permit requirements
 • Ensuring outside vendors have obtained any required permits or licenses prior to your event

TMH reserves the right to end any event early or remove any person from the premises who poses a safety risk, violates venue policies, or disrupts the operations of the venue.

7. VENDOR POLICY
TMH maintains a preferred vendor list for your convenience. You may use vendors outside of this list subject to approval and any applicable outside vendor fees as specified in your booking contract.
All vendors operating at TMH events must conduct themselves professionally, protect client privacy, and comply with applicable law. TMH is not responsible for the actions, conduct, quality of services, or failures of any third-party vendor — preferred or otherwise.

8. PHOTOGRAPHY & MEDIA
TMH may photograph or video record events held at our venue for use in marketing materials, social media, and promotional purposes. By booking with TMH, you grant us a non-exclusive, royalty-free license to use images or video from your event for these purposes.
If you do not wish to have your event photographed for TMH promotional use, you must notify us in writing at the time of booking. This preference will be noted in your contract.

9. INTELLECTUAL PROPERTY
All content on themakenziehouse.com — including but not limited to text, images, logos, graphics, and brand elements — is the property of The Makenzie House and is protected by applicable copyright and trademark laws.
You may not reproduce, distribute, modify, or use any TMH content for commercial purposes without our prior written consent.

10. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, The Makenzie House shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services, including but not limited to:
 • Loss of enjoyment or disappointment due to vendor performance
 • Weather-related or force majeure event disruptions
 • Technical failures of third-party platforms or tools
 • Personal injury or property damage caused by guests or outside vendors

TMH's total liability to you for any claim arising from our services shall not exceed the total amount paid by you to TMH for the specific event giving rise to the claim.

11. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless The Makenzie House, its owners, employees, contractors, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of our venue or services; (b) your breach of these Terms or your booking contract; (c) the conduct of your guests or outside vendors at your event; or (d) your violation of any applicable law or regulation.

12. PRIVACY
Your use of our website and services is also governed by our Privacy Policy, available at themakenziehouse.com/privacy-page. By using our services, you acknowledge and agree to the practices described in our Privacy Policy, including our commitment to protecting your personal information and our policy of not voluntarily disclosing client data to third parties without a valid legal instrument.

13. GOVERNING LAW & DISPUTE RESOLUTION
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of TMH services shall be subject to the exclusive jurisdiction of the state and federal courts located in Fort Bend County, Texas.
Prior to initiating any legal action, the parties agree to make a good-faith effort to resolve disputes informally by contacting TMH at info@themakenziehouse.com.

14. CHANGES TO THESE TERMS
TMH reserves the right to update or modify these Terms at any time. When changes are made, we will update the "Last Updated" date at the top of this page. Your continued use of our website or services after any changes constitutes your acceptance of the updated Terms.
We encourage you to review these Terms periodically. Material changes that affect existing bookings will be communicated to affected clients directly.
